1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of the website located at horse.fun (the "Website") and the interface it provides (collectively, the "Services"). The Services consist of a frontend interface that facilitates interaction with the horse.fun protocol (the "Protocol"), a set of open-source smart contracts operating on the Solana blockchain. By accessing or using the Website or Services — including by checking the acceptance box presented on first use — you agree to be bound by these Terms. If you do not agree, you must not access or use the Website or Services.

2. Eligibility

The Services are intended exclusively for users who are at least 18 years old or the age of majority in their jurisdiction, whichever is greater. By using the Services, you represent and warrant that you meet this requirement, that you have the legal capacity to enter into these Terms, and that your use of the Services is lawful in the jurisdiction from which you access them.

3. Description of the Services

The Website provides a frontend interface for users to interact with the Protocol. The Protocol is permissionless and wallet-based: it requires no registration or account creation, and users interact directly with its smart contracts through their own Solana-compatible wallets. All transactions are executed and recorded on the public Solana blockchain and are irreversible.

The Website operator ("we," "us," "our") hosts the interface only. We do not custody user funds, we do not process entries or payouts ourselves, and we do not control or influence race outcomes, which are determined entirely by the Protocol's on-chain logic and verifiable randomness as described below.

4. How the Protocol Works

• Races and entries. Simulated horse races run continuously. During each race's entry window, users may commit SOL to back one or more horses. Entry amounts are subject to on-chain minimums and maximums.
• Outcomes. Race results are determined by verifiable on-chain randomness (Switchboard). Neither we nor any third party can predict or influence a race's outcome. Each result can be independently verified on-chain.
• Prizes. Each race's pool is distributed according to percentages encoded in the Protocol (for example, to backers of the top-three finishers, proportional to their entries), after protocol-defined allocations such as fees, jackpot contributions, and buyback contributions. Winnings are claimable on-chain and remain claimable through the smart contracts.
• Jackpots. The Protocol maintains jackpot pools funded by a share of entry volume. Jackpot triggers are determined by verifiable randomness at fixed odds encoded on-chain and are subject to an on-chain volume-eligibility threshold. Jackpot payouts are split among eligible winners according to the Protocol's formula, which may weight staked reward-token balances.
• Reward token ($HORSE). The Protocol mints a reward token in proportion to race volume, subject to on-chain caps, and distributes it to participants proportional to their entries. The token may be staked within the Protocol; staked balances may be partially burned upon jackpot wins, as encoded on-chain.
• Auto Play. Users may optionally fund an on-chain escrow that authorizes a keeper to place entries on their behalf according to the strategy and limits the user configures. A per-race keeper fee applies. Users may close their escrow and withdraw remaining funds at any time, subject to on-chain conditions.
• Referrals. The Protocol pays referral commissions on referred users' entries at rates encoded on-chain. Referral earnings are claimable on-chain.
• Buyback. The Protocol may allocate a share of entry volume to an on-chain buyback vault. We make no representation regarding the use, timing, or effect of any buyback, or regarding the price or liquidity of any token.
• Parameters. Certain Protocol parameters (including fees, entry limits, emission rates, jackpot odds and thresholds) are configurable on-chain and may change. The values encoded in the smart contracts at the time of your transaction control.

5. Wallets and Self-Custody

You are solely responsible for your wallet, private keys, and credentials, including wallets provided through third-party infrastructure (such as embedded wallet providers). We do not store, control, or have access to your private keys or funds. Any loss arising from compromised wallets, phishing, incorrect transaction parameters, or user error is your sole responsibility.

6. Fees, Transactions and No Refunds

• The Protocol charges fees on entries as encoded in the on-chain program; rates are transparent and verifiable on-chain. Auto Play incurs an additional per-race keeper fee.
• Solana network fees apply to all on-chain interactions and are your responsibility.
• Due to the immutable nature of the blockchain, all transactions are final and non-refundable. We cannot reverse, cancel, or modify any transaction.
• We do not process fiat payments.

7. $HORSE Token

$HORSE is a reward token earned through participation in the Protocol. It is not an investment, is not offered or promoted as one, and carries no rights to profits, dividends, governance of any company, or any claim against us. It may have no value, and no market for it may exist. Nothing in the Services constitutes an offer or solicitation to purchase any token or security.

8. Assumption of Risk

The Services are provided for entertainment purposes. By using them you acknowledge and accept, without limitation, the following risks:

• Loss of funds. Race outcomes are determined by chance-based verifiable randomness. You may lose some or all of the funds you commit. Never commit funds you cannot afford to lose.
• Volatility. Cryptocurrencies, including SOL and $HORSE, are highly volatile and may lose value rapidly, including to zero.
• Blockchain risks. Transactions are irreversible. Network congestion, outages, forks, or failures of the Solana blockchain may delay or prevent transactions, including race resolution and claims.
• Smart contract risks. Smart contracts may contain bugs or vulnerabilities and may be exploited. We disclaim liability for losses arising from smart contract failure.
• Randomness and resolution risks. Race resolution depends on third-party randomness infrastructure and permissionless execution; resolution may be delayed or require retries.
• Regulatory risks. Laws applicable to cryptocurrencies and blockchain applications vary by jurisdiction and may change. You bear the risk that your use of the Services is or becomes restricted or unlawful where you are located.
• Third-party risks. The Services depend on third-party technologies (including the Solana blockchain, RPC providers, wallet infrastructure, and randomness oracles). We are not liable for their acts, omissions, or failures.

9. No Advice

Nothing in the Services constitutes financial, investment, legal, tax, or other professional advice. Consult qualified professionals for advice specific to your situation.

10. Jurisdictional Restrictions

You are solely responsible for determining whether your use of the Services is lawful in your jurisdiction, and you represent and warrant that it is. The Services are not offered to, and must not be used by, persons located in any jurisdiction where participation in chance-based games for cryptocurrency, or the use of cryptocurrency itself, is prohibited or restricted by applicable law.

We reserve the right, but assume no obligation, to restrict access to the Website from any jurisdiction at any time and without notice. Circumventing any such restriction (including through VPNs or similar means) is a violation of these Terms.

11. Legal Compliance, Sanctions and Taxes

• You must comply with all laws applicable to you, including anti-money-laundering (AML), counter-terrorism-financing (CTF), sanctions, and tax laws.
• You represent that you are not a person, and are not acting on behalf of a person, subject to sanctions administered by the United States, the European Union, the United Nations, or any other applicable authority, and that you are not located in a comprehensively sanctioned jurisdiction.
• You are solely responsible for determining, reporting, and paying any taxes arising from your use of the Services. We do not provide tax advice and do not withhold taxes.

12. Prohibited Conduct

You agree not to:

• Use the Services if you do not meet the eligibility requirements in Section 2
• Use the Services from a restricted jurisdiction or circumvent geographic restrictions
• Attempt to exploit, hack, disrupt, or manipulate the Website, the smart contracts, the randomness system, or the blockchain
• Use bots, scripts, or automated tools to interact with the Protocol other than through features the Protocol itself provides (such as Auto Play)
• Engage in money laundering, terrorist financing, fraud, or any other unlawful activity
• Transmit malware or other harmful code, or interfere with the operation of the Services
• Misrepresent your identity, age, or location, or provide false information
• Infringe the intellectual-property or other rights of any person

13. Intellectual Property

All content of the Website — including graphics, characters, animations, sounds, text, and branding — is owned by us or our licensors and protected by applicable intellectual-property laws. Except for open-source components made available under their own licenses, you may not reproduce, distribute, or create derivative works from Website content without our prior written consent. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Website for its intended purpose.

14. Privacy

Your use of the Services is subject to our Privacy Policy, which describes the limited information the Website handles. By using the Services, you consent to those practices.

15. Third-Party Services

The Services interoperate with third-party services and infrastructure we do not control, including the Solana blockchain, wallet providers, RPC providers, randomness oracles, and any decentralized exchanges or liquidity venues on which tokens may trade. Your use of third-party services is governed by their own terms, and we are not responsible for them.

16. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION. WE DO NOT WARRANT ANY OUTCOME, REWARD, OR RETURN FROM USE OF THE SERVICES. PAST RESULTS DO NOT INDICATE FUTURE RESULTS.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR CRYPTOCURRENCY, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

18. Indemnification

You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, contractors, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from or relating to your use of the Services, your violation of these Terms, your violation of applicable law, or your infringement of any third-party rights.

19. Force Majeure

We shall not be liable for any failure or delay in providing the Services due to events beyond our reasonable control, including natural disasters, wars, terrorism, labor disputes, government actions, blockchain network failures or outages, oracle failures, cyberattacks, or internet outages. We will make reasonable efforts to restore access to the Services as soon as practicable.

20. Suspension and Termination

We may suspend, restrict, or terminate your access to the Website at any time, without notice, for any reason, including suspected violation of these Terms. Because the Protocol is permissionless and non-custodial, termination of Website access does not affect assets recorded on-chain: any claimable balances remain accessible through the smart contracts. Provisions of these Terms concerning risk, disclaimers, liability, indemnification, and dispute resolution survive termination.

21. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which the Website operator is established, without regard to conflict-of-laws principles. Any dispute arising from or relating to these Terms or the Services shall be resolved exclusively through final and binding arbitration in that jurisdiction, on an individual basis only. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING AND ANY RIGHT TO A JURY TRIAL.

22. Changes to These Terms

We may update these Terms at any time by posting the revised version on the Website with an updated effective date. Continued use of the Services after changes constitutes acceptance of the updated Terms. Please check this page periodically.

23. Miscellaneous

• Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
• No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or transfer of the Website.
• Entire agreement. These Terms constitute the entire agreement between you and us regarding the Services and supersede any prior agreements.
